Terms of Use (EULA)

These Terms of Use are Dream Camera’s end user license agreement (“EULA”) for the Dream Camera mobile application and related services (the “Licensed Application”). Dream Camera is licensed, not sold, to you. Your use of the Licensed Application is also subject to Apple’s Licensed Application End User License Agreement (the “Standard EULA”), except where this custom EULA provides additional or more specific terms for Dream Camera, subscriptions, and our services.

1. Scope of License
Dream Camera (“Licensor”) grants you a nontransferable, non-exclusive license to use the Licensed Application on Apple-branded products that you own or control, and as permitted by the App Store Usage Rules. This EULA also covers content, materials, and services accessible from or purchased within the Licensed Application, and upgrades that replace or supplement it, unless an upgrade is accompanied by a different EULA.
Except as allowed by the Usage Rules, you may not distribute the Licensed Application or make it available over a network so it can be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application. If you sell your Apple device, remove the Licensed Application before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part of it, except to the extent that restriction is prohibited by applicable law or permitted by the licensing terms of open-source components included with the Licensed Application.
2. Account-Free Use and Your Content
Dream Camera may operate without a traditional account, using an installation- or device-scoped identifier for authentication, quota, entitlement, and job ownership. You retain ownership of photos and images you upload, create, or process. You grant Dream Camera a limited license to process, store, transmit, and display that content only as needed to provide the service, deliver results, support retries, prevent abuse, comply with law, and respond to support requests.
You are responsible for ensuring that content you submit does not infringe others’ rights and that you have the rights needed to process it through Dream Camera.
3. Auto-Renewable Subscriptions (Pro Plan)
Dream Camera offers an auto-renewable subscription (“Pro Plan”) that unlocks premium features such as ad-free use and other entitlements described in the app at the time of purchase.
- Title: Dream Camera Pro Plan (or the product name shown in the App Store / in-app purchase sheet).
- Length: Monthly auto-renewable subscription, billed for the period shown in the App Store purchase sheet.
- Price: The price displayed in the App Store purchase sheet for your region at the time of purchase. Prices may vary by country or region and may change as allowed by Apple and applicable law.
- Payment: Payment is charged to your Apple ID account at confirmation of purchase.
- Renewal: The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current rate.
- Management and cancellation: You can manage or cancel the subscription in Account Settings after purchase. On iOS, go to Settings → Apple ID → Subscriptions, or manage subscriptions in the App Store. Canceling stops future renewals; the current paid period remains available until it ends.
- Unused trial period: Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription where applicable.
Credit packs or other one-time purchases, if offered, are separate from the Pro Plan subscription and are governed by the purchase terms shown at checkout.
4. Consent to Use of Data
You agree that Dream Camera may collect and use technical data and related information—including technical information about your device, system and application software, and peripherals—gathered periodically to provide updates, product support, and other services related to the Licensed Application. We may use this information in a form that does not personally identify you to improve our products or provide services or technologies to you. Additional detail is in the Privacy Policy.
5. External Services
The Licensed Application may enable access to Dream Camera’s and/or third-party services and websites (“External Services”). You use External Services at your sole risk. Dream Camera is not responsible for examining or evaluating the content or accuracy of third-party External Services and shall not be liable for them. You will not use External Services in a manner inconsistent with this EULA or that infringes the intellectual property rights of Dream Camera or any third party. External Services may not be available in all languages or locations. Dream Camera may change, suspend, remove, disable, or limit External Services at any time without notice or liability.
6. Termination
This EULA is effective until terminated by you or Dream Camera. Your rights terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and delete all copies.
7. No Warranty
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DREAM CAMERA DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND SERVICES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE FROM DREAM CAMERA OR ITS AUTHORIZED REPRESENTATIVE CREATES A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON CONSUMER RIGHTS, SO THE ABOVE MAY NOT APPLY TO YOU.
8. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL DREAM CAMERA BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU. IN NO EVENT SHALL DREAM CAMERA’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DREAM CAMERA FOR THE LICENSED APPLICATION OR SUBSCRIPTION IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY DOLLARS ($50.00). THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
9. Export and Legal Compliance
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which it was obtained. In particular, the Licensed Application may not be exported or re-exported into any U.S.-embargoed countries or to anyone on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent that you are not located in any such country or on any such list, and that you will not use these products for purposes prohibited by United States law.
10. Governing Law
Except to the extent expressly provided below, this Agreement and the relationship between you and Dream Camera shall be governed by the laws of the State of California, excluding its conflicts of law provisions. If you are a citizen of any European Union country or of Switzerland, Norway, or Iceland, and you are not accessing the service from the U.S., disputes arising from this Agreement shall be governed by the laws and courts of your usual place of residence. The United Nations Convention on the International Sale of Goods is excluded.
11. Apple as Third-Party Beneficiary
You acknowledge that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. Dream Camera, not Apple, is solely responsible for the Licensed Application and its content. Apple has no obligation to furnish maintenance or support. To the extent any warranty is not effectively disclaimed, Apple’s sole warranty obligation is a refund of the purchase price of the Licensed Application upon notice of failure to conform. Apple has no other warranty obligation. Dream Camera, not Apple, is responsible for addressing claims relating to the Licensed Application, including product liability, consumer protection, privacy, or intellectual property claims, and for investigating, defending, settling, and discharging any such claim.
12. Changes
We may update these Terms of Use as Dream Camera changes. The updated version will be posted here with a new effective date. Continued use of the Licensed Application after changes become effective constitutes acceptance of the updated terms, except where applicable law requires additional consent.
